These Terms of Use (“Terms”) govern your access to and use of thebimmerhub.com and any related online forms, booking tools, content, and communication features operated by TheBimmerHub LLC (“TheBimmerHub,” “we,” “us,” or “our”).

By accessing or using the website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.

1. About TheBimmerHub

TheBimmerHub is an independent mobile BMW service and performance business based in North Carolina. We are not a BMW dealership and are not affiliated with, sponsored by, or endorsed by BMW AG, BMW of North America, or any BMW dealership.

BMW names, model designations, logos, and trademarks belong to their respective owners and are used only for identification and descriptive purposes.

2. Eligibility and Authority

You must be at least 18 years old and legally capable of entering into an agreement to use the website to request or authorize services.

When submitting information about a vehicle, you represent that you own the vehicle or have authorization from its owner to request information, obtain an estimate, schedule service, and authorize any approved work.

3. Website Information Is Not a Diagnosis

Website content is provided for general informational and promotional purposes. It is not a vehicle-specific diagnosis, repair instruction, safety determination, or guarantee that a particular service will correct a reported problem.

Automotive symptoms may have multiple causes. A reliable diagnosis may require physical inspection, testing, disassembly, programming, or additional information. Do not rely on website content as a substitute for professional inspection.

If a vehicle may be unsafe to operate, stop driving it and arrange appropriate transportation or towing.

4. Service Requests and Appointments

Submitting a booking form, message, or service request does not automatically create a confirmed appointment or require TheBimmerHub to accept the job.

An appointment is confirmed only after we accept the request and communicate confirmation. Availability, arrival times, service locations, and completion times are estimates and may change because of weather, traffic, parts availability, job conditions, emergencies, or delays involving earlier appointments.

We may decline, postpone, or discontinue a job when:

  • The requested work is outside our capabilities or service area

  • The location is unsafe, inaccessible, unlawful, or unsuitable for mobile automotive work

  • Weather or site conditions prevent safe service

  • Required tools, parts, information, or vehicle access are unavailable

  • The vehicle differs materially from the information provided

  • A customer or other person creates an unsafe, threatening, abusive, or disruptive environment

  • Performing the requested work would violate applicable law

5. Mobile-Service Location Requirements

You are responsible for providing a lawful and reasonably safe location where the vehicle may be serviced. Unless otherwise agreed, the location should provide sufficient space, a stable and reasonably level surface, safe access to the vehicle, and any permission required from the property owner or manager.

You must disclose known hazards and keep children, pets, bystanders, and unnecessary traffic away from the immediate work area. We may stop or refuse work if conditions are unsafe or unsuitable.

TheBimmerHub is not responsible for towing, storage, parking violations, property-owner restrictions, homeowners-association rules, or other location-related consequences outside our control.

6. Estimates, Pricing, and Authorization

Website prices, examples, and promotional statements are not binding estimates unless expressly identified as such.

Unless stated otherwise, estimates are valid for 30 days and are based on the information available when prepared. Pricing may change because of misidentified vehicles, hidden damage, previous repairs, modifications, seized or broken components, diagnostic findings, parts-price changes, shipping costs, taxes, or additional work authorized by the customer.

Applicable travel, supplies, disposal, payment-processing, programming, subscription, or third-party charges will be disclosed through the estimate, repair order, or invoice when applicable.

No additional work will be performed without authorization when authorization is required. Your approved estimate, repair order, invoice, warranty document, or other service agreement controls the actual automotive services provided. If one of those documents conflicts with these website Terms, the service-specific document controls for that transaction.

7. Payment and Financing

Unless otherwise agreed in writing, payment is due when service is completed or when indicated on the applicable estimate, repair order, or invoice.

Available payment methods may change. Any card-processing charge or other payment-related fee will be disclosed before payment when applicable.

Third-party financing services are offered and administered by independent providers. Financing approval, terms, interest, payments, disputes, and account decisions are controlled by the applicable provider. TheBimmerHub does not guarantee financing approval or any particular financing terms.

Failure to qualify for financing does not cancel payment obligations for work you have otherwise authorized.

8. Parts, Programming, and Vehicle Modifications

Parts availability, compatibility, and delivery dates are not guaranteed. Used, remanufactured, aftermarket, customer-supplied, or performance parts may differ in fitment, condition, lifespan, appearance, noise, comfort, or operation compared with new original-equipment parts.

Programming, coding, tuning, retrofits, and vehicle modifications may alter vehicle behavior, settings, powertrain operation, fuel requirements, emissions compliance, manufacturer warranties, reliability, or compatibility with future software updates.

You are responsible for accurately disclosing existing modifications, prior programming, vehicle damage, mechanical problems, title status, and other relevant conditions.

TheBimmerHub will not knowingly perform a service that is prohibited by applicable law. Nothing on the website should be interpreted as an offer to disable legally required safety or emissions equipment.

9. Warranties

Website content, general statements, estimates, and communications do not create a warranty unless expressly stated in a written warranty or service-specific agreement.

Qualifying repairs may be covered by TheBimmerHub’s written limited warranty. Coverage depends on the parts used, service performed, vehicle condition, mileage, and other stated requirements or exclusions.

The applicable written warranty governs any warranty claim. These Terms do not eliminate or restrict warranties or consumer rights that cannot legally be excluded or limited.

10. Customer-Supplied Parts

If we agree to install customer-supplied parts, you are responsible for confirming their identity, condition, quality, and compatibility unless we expressly agree otherwise in writing.

Additional labor resulting from incorrect, incomplete, defective, damaged, or incompatible customer-supplied parts may be charged separately if authorized. Warranty coverage may be limited to our workmanship and may not cover the customer-supplied part or labor required because that part failed or was incorrect, as explained in the applicable repair order or warranty terms.

11. Communications

By providing your contact information, you authorize us to respond through telephone calls, email, or text messages regarding your inquiry, estimate, appointment, service, payment, or warranty request.

Marketing texts will be sent only when legally permitted and, where required, after obtaining separate consent. Consent to receive marketing texts is not a condition of purchasing services. Text-message frequency varies, and message and data rates may apply. Reply STOP to opt out

Electronic communications and approvals may be retained as business records.

12. Acceptable Use

You may not:

  • Use the website for unlawful, fraudulent, deceptive, or abusive purposes

  • Submit false vehicle, identity, payment, ownership, or contact information

  • Attempt to gain unauthorized access to the website or connected systems

  • Introduce malicious code or interfere with website operation

  • Scrape, copy, reproduce, or commercially exploit website content without permission

  • Impersonate another person or submit a request without proper authority

  • Use the website to threaten, harass, defame, or harm another person

  • Misrepresent your relationship with TheBimmerHub

We may restrict access, reject requests, or take other appropriate action in response to suspected misuse.

13. Intellectual Property

Unless otherwise stated, the website’s original text, graphics, photographs, videos, branding, layout, and other content are owned by or licensed to TheBimmerHub and are protected by applicable intellectual-property laws.

You may view and use the website for personal, noncommercial purposes. You may not reproduce, modify, distribute, sell, publish, or commercially exploit our content without prior written permission.

14. Information and Content You Submit

You retain ownership of photographs, videos, messages, reviews, and other content you submit.

You grant TheBimmerHub permission to store, review, reproduce, and share submitted content as reasonably necessary to respond to your request, document vehicle condition, provide service, administer a warranty, resolve a dispute, maintain business records, or comply with law.

We will obtain additional permission before using privately submitted vehicle photographs or videos primarily for public advertising, unless the content was submitted for that stated purpose or published by you as a public review or social-media interaction.

15. Third-Party Services and Links

The website may link to or integrate with payment processors, financing providers, parts suppliers, tuning platforms, social-media services, mapping services, or other third parties.

We do not control those services and are not responsible for their availability, security, content, policies, products, or decisions. Your use of a third-party service is governed by its own terms and privacy policy.

16. Website Availability and Disclaimer

We attempt to keep the website accurate and available, but we do not guarantee that it will always be uninterrupted, secure, current, complete, or error-free.

To the fullest extent permitted by law, the website and its general content are provided “as is” and “as available,” without warranties of any kind. This website disclaimer applies to use of the website and does not replace any written warranty covering paid automotive work.

17. Limitation of Liability

To the fullest extent permitted by law, TheBimmerHub and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages resulting solely from your access to, inability to access, or reliance on the website or its general content.

This limitation does not exclude liability that cannot legally be limited and does not replace the terms governing paid automotive services, property damage, personal injury, warranty coverage, or any separately signed repair order.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TheBimmerHub and its owners, employees, and contractors from third-party claims, losses, or expenses arising from your unlawful misuse of the website, material violation of these Terms, submission of information you had no right to provide, or infringement of another person’s rights.

This section does not require you to indemnify TheBimmerHub for its own negligence, willful misconduct, or violation of law.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Before filing a legal claim concerning the website, you and TheBimmerHub agree to make a reasonable good-faith effort to resolve the dispute directly. If the dispute cannot be resolved, it may be brought in a court with lawful jurisdiction in Union County, North Carolina, unless applicable law requires otherwise.

Nothing in these Terms prevents either party from using small-claims court when eligible or from seeking emergency injunctive relief when appropriate.

20. Termination

We may suspend or terminate access to the website or online services when reasonably necessary to protect the website, our business, our customers, or others; address suspected misuse; or comply with law.

Sections that logically should continue after termination—including intellectual-property, disclaimer, liability, indemnification, and dispute provisions—will remain effective.

21. Changes to These Terms

We may revise these Terms as our website, services, or legal obligations change. Updated Terms will be posted on this page with a revised effective date.

Changes apply prospectively after publication and do not alter an already authorized repair order or written service agreement unless both parties agree or applicable law permits the change.

22. General Provisions

If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver of the right to enforce it later.

These Terms, together with the Privacy Policy and any applicable estimate, repair order, invoice, warranty document, or other written agreement, constitute the relevant agreement between you and TheBimmerHub concerning the matters they address.
